Court upholds most counts against ex-financier

A U.S. appeals court on Thursday upheld 10 convictions against an Indianapolis financier but overturned two wire fraud counts, saying the government failed to enter into the record key documentary evidence.
Timothy Durham and co-defendants Jim Cochran and Rick Snow were convicted in 2012 of swindling thousands of investors out of $200 million. Durham was convicted on 12 counts and sentenced to 50 years; Cochran was convicted on eight counts and sentenced to 25 years; Snow was convicted on five counts and sentenced to 10 years.
The 7th Circuit Court of Appeals in Chicago rejected most of the appeals but overturned two involving the transfer of $250,000 and $50,000.
The appeals court said the government's failure to enter the documentary evidence "was clearly an oversight, but the mistakes leaves a crucial gap in the evidence in those counts." It said the government used single-page printouts to establish the wire transfers were made in furtherance of the fraudulent scheme.

Top India court says coal allocations were illegal

India's Supreme Court says all government allocations of coal reserves to private companies from 1993 to 2009 were conducted illegally, and it will hold a hearing to decide whether to cancel them.
More than 200 coal blocks, or areas of unmined reserves, were allocated during that period to companies for their use in power plants or steel or cement factories.Companies were allowed to sell excess coal on the open market, but the court said Monday that commercial sales of coal from the reserves must be suspended until it makes its decision.
The court's ruling extends beyond an initial case in which the previous federal government was accused of costing the treasury hundreds of billions of dollars by allocating about 155 coal blocks without competitive bidding in 2004-09. |

Brazil's Supreme Court elects new president

Brazil's Supreme Court has elected a new president to replace the body's first black justice, who announced his early retirement in June.
Nine of the court's 10 judges elected Ricardo Lewandowski as the new chief justice Wednesday to succeed Joaquim Barbosa. The choice was not a surprise because the Supreme Court's presidency always goes to the justice who has sat on the bench the longest.
Barbosa is the only black to ever serve on Brazil's top court. He presided over a high-profile corruption trial in 2012 that sent more than 20 people to jail in a congressional payoff scheme. The case made him a household name and he was frequently mentioned as a potential presidential candidate, but he has said he has no desire to run for elective office.

Washington high court to hear charter school case

The Washington Supreme Court has agreed to consider whether the state's voter-approved charter school law violates the state constitution.
Oral arguments concerning the lawsuit brought by charter school opponents have been scheduled for the afternoon of Oct. 28.
A King County Superior Court judge found in December that parts of the new law are unconstitutional. Judge Jean Rietschel's decision focused on whether certain taxpayer dollars can be used to pay for the operation of charter schools.
Both sides asked the Supreme Court to skip the appeals court process and directly review the case.
Attorney Paul Lawrence says the briefs to the court and the oral arguments will focus on that part of the lawsuit.
The state's charter school system was approved by voters in 2012. |

Tennessee man pleads guilty to forgery

A Tennessee man has pleaded guilty to two counts of forgery of the signatures of a district court judge and an officer of the U.S. District Court.
U.S. District Judge Pamela L. Reeves set sentencing for 49-year-old Scott Thibault of Maryville for Dec. 1 in Knoxville. Thibault entered the plea Wednesday.
Prosecutors say Thibault has also agreed to plead guilty to one-count information of use of the mail to defraud.
Prosecutors say Thibault falsely represented himself as an attorney in an adoption case and forging the name of U.S. District Judge Thomas Varlan on the documents.
Thibault told the court he obtained at least $400,000 from the victims to further his scheme to defraud and obtain money. |
