India top court lifts ban on female makeup artists
Law Firm News | 2014/11/11 14:32
India's Supreme Court on Monday ordered the lifting of a ban on women working as makeup artists in the movie industry, ending a decades-long discriminatory practice.

India's film industry is among the most prolific in the world with nearly 1,500 films produced annually, most of them in Bollywood, as the Mumbai Hindi film industry is called.

The Cine Costume Makeup Artists and Hair Dressers Association had an unofficial ban on women as makeup artists, though they could work as hairdressers to the stars.

Judge Dipak Misra also struck down a regulation that people had to live in a particular city or town for five years to become a member of the association.

The court order came on a petition by makeup artist Charu Khurana, whose case was supported by the National Commission for Women, a state organization that protects women's rights.

Spanish court clears way for trial of princess
Headline Legal News | 2014/11/07 11:13

A court cleared the way for Princess Cristina, the sister of Spain's king, to be tried on tax fraud charges Friday in a landmark investigation affecting the royal family.

The case's investigative judge, Jose Castro, must now decide over the coming weeks whether to formally indict the princess, but this might not occur given that the state prosecutor and tax authorities say there is no basis for tax fraud charges against her.

Cristina*s lawyers maintained Friday that Spain's Supreme Court has ruled that people can't be tried on tax charges if neither the prosecutor nor tax authorities present charges.

The Palma de Mallorca court paved the way for Cristina's indictment after rejecting appeals against her being listed as a suspect in a corruption and embezzlement investigation centering on her husband, Inaki Urdangarin.

Castro said Cristina, 49, is suspected of two counts of cooperation in tax fraud. The court dropped a possible charge for embezzlement against her.

Urdangarin is suspected of embezzlement and fraud. He too has yet to be formally charged.

Court seems to favor fired whistleblower
Attorney News | 2014/11/05 13:20
The Supreme Court on Tuesday seemed inclined to rule in favor of a former federal air marshal who wants whistleblower protection for leaking information about aviation security plans.

Several of the justices indicated during oral argument that Robert MacLean did not violate the law when he revealed to a reporter government plans to cut back on overnight trips for undercover air marshals despite a potential terror threat.

MacLean said he leaked the information to an MSNBC reporter after supervisors ignored his safety concerns. His revelations in 2003 triggered outrage in Congress and the Department of Homeland Security quickly decided not to make the cutbacks, acknowledging it was a mistake.

But MacLean was fired from the Transportation Security Administration three years later, after the government discovered he was the leaker.

A federal appeals court ruled last year that MacLean should be allowed to present a defense under federal whistleblower laws. The Obama administration argues that whistleblower laws contain a major exception — they do not protect employees who reveal information "prohibited by law."

Deputy Solicitor General Ian Gershengorn told the justices that TSA regulations specifically prohibit disclosure of "sensitive security information," including any information relating to air marshal deployments.

But several of the justices pointed out that the Whistleblower Protection Act refers only to other laws, not agency regulations.

"So it is prohibited by regulations, let's not play games," Justice Antonin Scalia told Gershengorn.

Justice Stephen Breyer suggested that since no law seemed to ban the kind of information MacLean leaked, the president could simply issue an executive order to keep TSA workers from disclosing that kind of information.
