Panama high court OKs corruption probe of ex-president

Panama's Supreme Court voted Wednesday to open a corruption probe against former President Ricardo Martinelli, a move likely to rally popular support in a nation where the politically powerful rarely face justice for misdeeds.
A statement from the court said all nine judges voted to appoint a special prosecutor to investigate Martinelli over allegations he inflated contracts worth $45 million to purchase dehydrated food for a government social program.
The accusation is based on the testimony of a political ally, Giacomo Tamburelli, the former head of the National Assistance Program who has said he was taking orders from the then president to inflate contracts. He is now under house arrest.
Martinelli, a billionaire supermarket magnate, has denied the charges and says he is the target of political persecution by his successor, Juan Carlos Varela, who broke with the government in 2011 while serving as Martinelli's vice president and foreign minister. |

Nebraska court could hold up Keystone pipeline

The Republican-led Congress appears ready to approve the Keystone XL oil pipeline, but no matter what actions are taken in Washington, the entire 1,179-mile project could be delayed until Nebraska signs off on the route.
After several years of intense debate, the routing process is before the Nebraska Supreme Court, and depending on how the justices rule, months or years could pass before construction begins in that state.
Even if approval comes from Washington and the high court, opponents are looking for new ways to block the project, including filing a federal lawsuit on behalf of Native American tribes in Nebraska and South Dakota over the possible disruption of Indian artifacts.
The court is considering whether an obscure agency known as the Nebraska Public Service Commission must review the pipeline before it can cross the state, one of six on the pipeline's route. Gov. Dave Heineman gave the green light in 2013 without the involvement of the panel, which normally regulates telephones, taxis and grain bins.
The justices have given no indication when they will render a decision.
President Barack Obama has said he is waiting for the court's decision, and the White House on Tuesday threatened to veto the bill in what was expected to be the first of many confrontations with the new Congress over energy and environmental policy. |

Argentine court says US fugitive can be extradited

Argentina's Supreme Court has ruled that an American who took refuge and started a new life in the South American country can be extradited to face charges that he killed his wife over a decade ago, a court spokeswoman confirmed Saturday.
Kurt Sonnenfeld moved to Argentina in 2003 and sought asylum after prosecutors in Denver charged him with first-degree murder. The decision to extradite him brings to an end a longstanding dispute between the U.S. Justice Department and Argentine courts that centered in part on differences over the death penalty.
In the ruling, which was made Dec. 11, the justices said U.S. prosecutors had assured Argentina that "the death penalty will not be imposed, or if it were ruled, it will not be exercised in this case." The ruling said the executive branch will have final say on an extradition and doesn't specify when it may take place.
Maria Bourdin, a spokeswoman for Argentina's Supreme Court, confirmed the ruling but declined to comment beyond what was in it. Calls to the U.S. Embassy in Buenos Aires on Saturday seeking comment were not immediately returned. |

Indian guru in deadly standoff due in court

An Indian guru at the center of a deadly standoff with police was set to appear in court Friday after he was arrested at his sprawling ashram for refusing to answer murder charges.
Nearly 15,000 supporters of the 63-year-old Sant Rampal were evacuated from his compound in Haryana state before police took him away in an ambulance Wednesday. Previous attempts by riot police to enter the fortified estate, about 175 kilometers (110 miles) from New Delhi, had resulted in deaths and injuries as Rampal's followers, some of whom were armed, fought back.
The self-styled guru was taken to Chandigarh, the state capital, to appear before a court Friday.
He has repeatedly ignored orders to answer a 2006 murder charge against him. Police have filed additional charges against him and some of his supporters, including sedition, murder, criminal conspiracy and detaining people illegally in his fortress, said Jawahar Yadav, a Haryana state government spokesman.
More than 400 people have been arrested and about 200 others injured, including security forces, during the dayslong standoff.
The guru's followers on Wednesday handed over to police the bodies of four women who apparently died inside the 12-acre (5-hectare) complex. Another woman and an 18-month-old child died in a hospital after leaving the ashram.
The circumstances of the deaths were not clear and autopsies were being conducted. |

Court rejects appeal over Senate filibuster rules

The Supreme Court on Monday rejected an appeal from a public interest group and four members of Congress who challenged the Senate filibuster as unconstitutional.
The justices let stand a lower court ruling that said Common Cause and the lawmakers did not have legal standing to pursue the case.
The plaintiffs argued that Senate rules requiring at least 60 votes to bring legislation to a vote violates the constitutional principle of majority rule. A federal appeals court said the lawsuit was filed against the wrong parties.
The case was brought against Vice President Joe Biden in his role as president of the Senate, and against the Senate's secretary, parliamentarian and sergeant at arms.
Common Cause says it can't sue the Senate directly because that is barred under the Constitution's Speech and Debate Clause.
Last year, the Senate voted to end use of the filibuster rule from blocking most presidential nominees. Democrats said they ended the rule out of frustration that Republicans were routinely using the tactic to block President Barack Obama's nominees for pivotal judgeships and other top jobs.
But 60 votes are still required to end filibusters against legislation. |
