Rooney gets road ban after pleading guilty to drunk driving

Former England captain Wayne Rooney pleaded guilty to drunk driving on Monday, leading to a court imposing a two-year driving ban and ordering him to perform 100 hours of unpaid community work.
The Everton striker was stopped by police outside Manchester on Sept. 1 while driving someone else's car.
Rooney was three times above the legal limit for driving with alcohol in the body, the hearing at Stockport Magistrates' Court was informed as the 31-year-old player entered his guilty plea.
"Following today's court hearing I want publicly to apologize for my unforgivable lack of judgment in driving while over the legal limit. It was completely wrong," Rooney said in a statement.
"I have already said sorry to my family, my manager and chairman and everyone at Everton FC. Now I want to apologize to all the fans and everyone else who has followed and supported me throughout my career."
A breathalyzer test showed Rooney's alcohol level was 104 micrograms in 100 milliliters of breath. The driving limit in England and Wales is 35 micrograms per 100 milliliters of breath.

German court orders sentence enforced in Chile abuse case

A court in western Germany has ruled that a German man must serve the sentence of a Chilean court for his role in the sexual abuse of children at a secretive German colony in Chile.
The dpa news agency reported Monday that the court in the town of Krefeld said Hartmut Hopp must serve in Germany the five-year sentence given to him by a Chilean court in 2011 for 16 counts of aiding in the sexual abuse of children.
The crimes took place at the Colonia Dignidad enclave, where residents were physically and psychologically abused for three decades beginning in 1961 after moving there from Germany.
Hopp fled to Germany before the verdict took legal effect. The 73-year-old denies the charges and his attorney says he will appeal the ruling.

Open records policy set for administrative court records

Kentucky's Supreme Court justices have approved an open records policy to guide how the public accesses administrative records in the state court system.
State officials say the first open records policy for the Administrative Office of the Courts takes effect Aug. 15. The AOC is the operations arm of the state's court system.
The new policy describes how to submit an open records request to AOC.
Kentucky Chief Justice John D. Minton Jr. says the judicial branch has long complied with the "spirit" of the open records law, but says it's time to formalize its commitment in a written policy.
First Amendment expert and Louisville lawyer Jon Fleischaker says he's looked forward to the time when the public had definitive guidance on how to access the court system's administrative records. |

Idaho Judicial Council accepting applications for high court

An opening on the Idaho Supreme Court won't be filled through an election but through an application process.
Supreme Court Justice Daniel Eismann announced earlier this year he will retire in August — 16 months before the end of his current six-year term.
Because Eismann is stepping down early, the Idaho Judicial Council will solicit applications and recommend up to four names to the governor for appointment instead of waiting until the 2018 election, The Spokesman-Review reported. Idaho's Supreme Court positions are nonpartisan.
It's a merit-based process that had been used primarily to replace outgoing justices until this past year when former Idaho Supreme Court Justice Jim Jones announced he would retire at the end of his term.
"I would never have been on the court if the only avenue was to go through the Judicial Council and be appointed by the governor," said Jones, 74, who was twice elected Idaho attorney general. "It just didn't even occur to me as a possibility, because if you've been involved in the political arena, you probably at one time or another have stepped on the toes of whoever ends up being governor."
Eismann joined the state's highest court in 2001 after successfully running against incumbent Justice Cathy Silak. That election was the first time in 68 years that a sitting supreme court justice had been ousted in an election.
He caused a stir when he decided to announce his election campaign at a Republican Party event in eastern Idaho. He has since become one of the most outspoken justices, known for his tough questioning and advocating for specialty courts throughout Idaho.

Judge W. Brent Powell Appointed to Missouri Supreme Court

Jackson County Circuit Judge W. Brent Powell was appointed Tuesday to the Missouri Supreme Court, marking the first high-profile judicial selection by new Republican Gov. Eric Greitens.
Powell will replace former Judge Richard Teitelman, who died in November at his home in St. Louis.
Powell, a 46-year-old Kansas City resident, was appointed by former Republican Gov. Matt Blunt as a Jackson County judge in 2008. He previously spent seven years as an assistant U.S. attorney in Kansas City and also worked as an assistant Platte County prosecutor.
Greitens said Powell has established himself as "an outstanding jurist."
"He has received high marks for being humble, fair-minded and of the highest integrity," Greitens said in a written statement accompanying his announcement. "I am confident Judge Powell will be committed to strengthening and improving our court system and guarding the rule of law as a judge on our state's highest court."
Powell's wife, Beth Phillips, was appointed as a U.S. district judge in 2011 by Democratic President Barack Obama after serving as U.S. attorney in Kansas City. His sister-in-law, Jennifer Phillips, was appointed to the Jackson County Circuit Court in 2014 by former Democratic Gov. Jay Nixon after serving as an assistant county prosecutor. Powell's father, his father-in-law, an uncle and several cousins also have been attorneys.
"Coming from a clan of lawyers, this is a very special day for me and my family," Phillips said Tuesday in a written statement. "As I step into this new role, I hope to model the humility and judicial temperament exhibited by the late Judge Richard Teitelman who was known for his kindness and congeniality."
Unlike at the federal level, Missouri Supreme Court appointees are not subject to Senate confirmation. Instead, Powell will face a retention vote for a 12-year term during the 2018 general election.
Powell's appointment could shift the court a little to the right. Though Missouri appeals judges don't run as Democrats or Republicans, Teitelman had been appointed by former Democratic Gov. Bob Holden and typically aligned along liberal lines.
Powell's addition will mean three of the state's seven Supreme Court judges were appointed by Republican governors. |

Kenya court blocks closing of world's biggest refugee camp

A Kenyan court ruled Thursday that the government must not close the world's largest refugee camp and send more than 200,000 people back to war-torn Somalia, a decision that eases pressure on Somalis who feared the camp would close by the end of May.
Kenya's internal security minister abused his power by ordering the closure of Dadaab camp, Judge John Mativo said, adding that the minister and other officials had "acted in excess and in abuse of their power, in violation of the rule of law and in contravention of their oaths of office."
Rights groups Amnesty International, Kituo cha Sheria and the Kenyan National Commission on Human Rights had challenged the government's order to close the camp, which has operated for more than a quarter-century.
Kenya's government quickly said it will appeal the ruling. "Being a government whose cardinal responsibility is first to Kenyans, we feel this decision should be revoked," spokesman Eric Kiraithe said.
The judge called the order discriminatory, saying it goes against the Kenyan constitution as well as international treaties that protect refugees against being returned to a conflict zone.
President Uhuru Kenyatta's government has not proved Somalia is safe for the refugees to return, the judge said, also calling the orders to shut down the government's refugee department "null and void."
Somalia remains under threat of attacks from homegrown extremist group al-Shabab. Some Kenyan officials have argued that the sprawling refugee camp near the border with Somalia has been used as a recruiting ground for al-Shabab and a base for launching attacks inside Kenya. But Kenyan officials have not provided conclusive proof of that.
